Surprise! Apple and Samsung Still Don't Agree to Agree.

February talks were a bust, but mediator communication continues.

To precisely no one’s surprise, it seems Apple and Samsung’s mediated settlement talks for their long-running patent suits have once again gone nowhere.

During the first week of February, the parties — including Apple Chief Executive Tim Cook and Samsung’s co-CEO JK Shin — met for a full-day session. But they “did not reach an agreement,” according to a joint report to Judge Lucy Koh first published by Foss Patents.

But hope springs eternal, and the parties appear to remain engaged in the talks, with Apple having no less than six communications with the mediator to Samsung’s four.

Judge Koh had ordered both sides to meet and to update her on their progress. A trial is scheduled for March.

This is a follow-up to the previous trial (and partial retrial) in which Samsung was found to have infringed on Apple patents and ordered to pay hundreds of millions of dollars in damages. The new case is similar but involves somewhat different patents and a newer generation of products.
